Nordlicht Media OÜ respects the intellectual property of others and expects users of Media to do the same. We respond to notices of alleged infringement that comply with the Digital Millennium Copyright Act (17 U.S.C. § 512) and equivalent laws, and we terminate the accounts of repeat infringers.
1.Designated agent
Send notices to our designated copyright agent by email at [email protected], or by post to Nordlicht Media OÜ, Attn: Copyright Agent, Vana-Lõuna 39/1, 10134 Tallinn, Estonia.
2.How to file a notice
A valid notice must include:
- the URL(s) of the material you claim is infringing, sufficient to let us locate it;
- identification of the copyrighted work you claim has been infringed, or a representative list if several;
- your name, address, telephone number and email address;
- a statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent or the law;
- a statement, under penalty of perjury, that the information in the notice is accurate and that you are the owner or authorised to act on the owner's behalf;
- your physical or electronic signature.
Notices that are incomplete may not be actionable. Knowingly misrepresenting that material is infringing may expose you to liability for damages under 17 U.S.C. § 512(f).
3.What happens next
On receipt of a valid notice we remove or disable access to the material promptly, typically within one business day, notify the user who posted it, and record the notice. We may provide a copy of the notice, including your contact details, to the affected user.
4.Counter-notification
If you believe your material was removed by mistake or misidentification, you may send a counter-notification to [email protected] containing: identification of the removed material and its former location; a statement under penalty of perjury that you have a good-faith belief it was removed as a result of mistake or misidentification; your name, address and telephone number; consent to the jurisdiction of the courts at your address (or, if outside the United States, of the courts where Nordlicht Media OÜ is located) and to accept service from the complainant; and your signature.
Unless the complainant informs us within 10 business days that they have filed an action seeking a court order, we may restore the material within 10 to 14 business days.
5.Repeat infringers
We keep a record of notices. Accounts that receive three valid notices within twelve months are terminated, and we may terminate earlier at our discretion.
6.Other rights
Trademark, privacy, and right-of-publicity complaints, and requests from performers to remove content depicting them, may be sent to [email protected]. Performer removal requests are prioritised and actioned without requiring proof of copyright ownership.
