Terms of Service

1.Eligibility

The Service contains sexually explicit material intended for adults. You may only access it if you are at least 18 years of age (or the age of majority in your jurisdiction, whichever is higher) and if viewing such material is lawful where you are located.

By entering you represent and warrant that you meet these requirements, that you are accessing the Service voluntarily, and that you will not permit any minor to access it through your device or account.

2.Accounts

You may create an account with an email address, a username and a password. You are responsible for keeping your credentials confidential and for all activity under your account. Notify us at [email protected] immediately if you believe your account has been compromised.

We may suspend or terminate accounts that violate these Terms, that are inactive for an extended period, or where required by law. You may delete your account at any time from your profile page.

3.Acceptable use

You agree not to:

• upload, link to, or otherwise distribute content that depicts any person under 18, non-consensual acts, or that you do not have the right to distribute;
• harass, threaten, impersonate or defame any person, including performers, channels and other users;
• scrape, crawl, mirror or download content by automated means, or circumvent any technical measure that limits access to the Service;
• interfere with the operation of the Service, probe its security, or use it to distribute malware or unsolicited messages;
• use the Service for any unlawful purpose or in violation of any applicable law.

4.User content

Comments, playlists, channel descriptions and any other material you submit ("User Content") remain yours. By submitting User Content you grant us a worldwide, non-exclusive, royalty-free licence to host, display, reproduce and distribute it in connection with operating and promoting the Service.

You represent that you own or have the necessary rights to your User Content, that it does not infringe the rights of any third party, and that it complies with these Terms. We may remove User Content at our sole discretion, with or without notice.

5.Intellectual property

The Service, including its software, design, trademarks and the content published by us or our licensors, is protected by copyright, trademark and other laws. Except as expressly permitted, you may not copy, modify, distribute, sell or lease any part of the Service.

Complaints about infringing content are handled under our Copyright and Takedown Policy (DMCA).

6.Privacy

Our Privacy Policy explains what data we collect and why. By using the Service you consent to the processing described there.

7.Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, secure or error-free, or that content will be accurate or available at any particular time.

8.Limitation of liability

To the fullest extent permitted by law, Nordlicht Media OÜ and its officers, employees and partners shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, data or goodwill, arising out of or in connection with your use of the Service. Our aggregate liability for any claim shall not exceed one hundred euros (EUR 100).

9.Indemnity

You agree to indemnify and hold harmless Nordlicht Media OÜ from any claim, loss or expense (including reasonable legal fees) arising from your User Content, your use of the Service or your breach of these Terms.

10.Changes to the Service and the Terms

We may modify or discontinue the Service, or any part of it, at any time. We may update these Terms; the date at the top of this page indicates the last revision. Continued use after a change constitutes acceptance of the revised Terms.

11.Governing law and disputes

These Terms are governed by the laws of Estonia, without regard to conflict-of-law rules. Any dispute shall be submitted to the competent courts of the registered seat of Nordlicht Media OÜ, unless mandatory consumer law grants you the right to bring proceedings elsewhere.
